J&J implants: Decision on compensation likely in March

In what could end the uncertainty for patients in the J&J’s faulty hip implant case, the Delhi High Court is likely to decide on the quantum of compensation that patients should receive from multinational pharmaceutical giant Johnson and Johnson (J&J), in a hearing slated to happen next month.

The court had earlier directed J&J to pay ₹25 lakh each to patients as an interim compensation till a final decision is taken on the quantum of compensation by the court. The court will decide whether the formula, that was devised to ascertain the total quantum of compensation which patients are entitled to, was appropriate or not.

The court had earlier in May 2019 directed J&J to pay ₹25 lakh each to 67 patients in the Acetabular Surface Replacement (ASR) hip implants case. The court in the next hearing will also see if the compensation should be paid only to those patients who underwent a revision surgery due to the implant, people in the know told ET.

India’s drug regulatory authority had earlier asked J&J to pay ₹65 lakh and ₹ 74 lakh as compensation to two unidentified patients in Maharashtra.
